If you are an NRI living in California and need to authorize a family member, relative, or representative in India to handle a property transaction on your behalf, you can execute a Power of Attorney (POA) without travelling to India.
This guide explains the complete procedure for creating a valid Indian Power of Attorney in California for use in India.
Step 1: Draft the Power of Attorney
Prepare the Power of Attorney in Word format based on the specific purpose, such as:
- Buying property in India
- Selling property in India
- Registering documents
- Managing bank-related matters
- Representing you before government authorities
Ensure that the powers granted are clearly defined.
Step 2: Print and Sign the Power of Attorney
Print the POA on standard A4-size paper.
- Affix a recent passport-size photograph on the last page of the document.
- Do not sign the document before meeting the notary public.
Step 3: Notarize the Power of Attorney in California
Visit a licensed Notary Public in California.
- Sign the Power of Attorney in the presence of the notary.
- Sign or initial all pages of the POA, wherever required.
- The notary will verify your identity and affix their seal and signature on the document.
Step 4: Send the Original POA to India
After notarization, courier the original Power of Attorney to your representative (POA holder) in India through a reliable international courier service
Step 5: Adjudicate the Power of Attorney in India
Once the original document reaches India, it must be adjudicated at the jurisdictional District Registrar's Office
After adjudication, the POA becomes usable for the intended purpose in India.
