What to Do If You Lose Your Original Property Deed in Karnataka

Losing your property’s original deed in Karnataka can be stressful and worrisome. However, there is a clear legal process to restore your documents and safeguard your ownership rights. This guide explains the essential steps, along with a real-life case study from one of our clients.

STEPS TO FOLLOW IF YOU LOSE THE ORIGINAL DEED

Step 1: Obtain a Certified Copy of the Sale Deed
If your property was registered after 2004, you can retrieve a certified copy online through the Kaveri Online Services portal. Older records can be accessed at the respective Sub-Registrar Office (SRO).

Step 2: Prepare an Affidavit
Draft an affidavit on Rs.100 e-stamp paper stating that you have lost the original deed. This affidavit is required for filing a police complaint and for future reference.

Step 3: File a Police Complaint
Submit the affidavit along with a written complaint to the local police station. Obtain an acknowledgement copy or a Non-Traceable Report, as this will serve as proof of loss.

Step 4: Publish Newspaper Advertisements
Publish a notice in two newspapers, one in English and one in the local language (Kannada), informing the public about the lost deed. This allows anyone with objections to raise them within the stipulated period.

CASE STUDY: LOST DEED RECOVERED THROUGH LEGAL STEPS

One of our clients registered a sale deed on 7th April 2018. Unfortunately, in January 2022, during travel, they lost all their property documents, including the sale deed, encumbrance certificate, khata, and tax-paid receipt. They did not even remember the registration number of the sale deed.

Here’s how we helped them:

Searching Through Kaveri Online Services
Since the property was registered after 2004, we searched the Encumbrance Certificate (EC) online using the client’s name (Sheena) and property address. From the EC, we retrieved the registration number of the sale deed. We highlighted the registration number in image below
