The validity of a notarized Power of Attorney (POA) for the registration of a Sale Deed depends on where the POA is executed. If the POA is executed outside India, notarization is typically accepted for property transactions. CASE 1: NOTARIZED POA EXECUTED ABROAD – ACCEPTED
For instance, our clients Mr. Arun and Mrs. Shetal, who reside in Australia, jointly own a 2BHK flat in Bangalore. As they were unable to be physically present for the transaction, they executed a Special Power of Attorney (SPOA) before a Notary Public in Australia. Using this notarized SPOA, we successfully registered the Sale Deed at the sub-registrar’s office in Bangalore. Below is the registered Sale Deed referencing the SPOA:
CASE 2: NOTARIZED POA EXECUTED IN INDIA – REJECTED
Conversely, when a POA is executed in India without registration, it is typically not accepted for Sale Deed registration.
For example, one of our clients in India planned to sell his property in Bangalore. However, during the registration of the Sale Deed, he was scheduled to be in New Jersey, USA. Before leaving, he executed a General Power of Attorney (GPA) in India on Rs. 200 non-judicial e-stamp paper and had it notarized.

Unfortunately, the sub-registrar’s office rejected this GPA during the Sale Deed registration process. The system displayed the following remark: “Not upload proper POA”, indicating that only a registered Power of Attorney is acceptable for such transactions.
Had the client registered the GPA in India at the sub-registrar's office before leaving India, it would have cost him less than Rs. 1,000. Instead, he now has to re-execute the GPA in the USA. The process involves:
- Notary fees in New Jersey: $250
- International courier charges: $50
- Total cost in INR: Approximately Rs. 25,000
This expense could have been avoided with a simple registration in India.
