How to Make a Power of Attorney (POA) in the USA for Property in India

A Power of Attorney (POA) is a legal document through which one person, known as the Principal, authorizes another person, known as the Agent or Attorney Holder, to act on their behalf.

For property-related matters in India, a POA can be especially useful for NRIs and Indian citizens living abroad who are unable to travel to India personally. Depending on the authority granted, the Agent may be authorized to perform specific activities such as signing documents, appearing before government authorities, managing property, or completing property registration formalities.

This article explains the general procedure for executing a Power of Attorney in the USA for use in India, with particular reference to property transactions in Karnataka.

Step 1: Prepare the Power of Attorney Draft

The first step is to prepare the POA document containing the details of the Principal, Agent, property, and the powers being granted.

For property-related matters, the POA should clearly specify the purpose for which the Agent is being appointed and the exact powers being granted.

It is advisable to have the draft prepared carefully because the wording of the POA can affect the subsequent adjudication and registration process in India.

Step 2: Print the POA on Plain Paper

Once the draft is finalized, print the Power of Attorney on plain A4-size paper unless the executing authority or receiving authority has specified a different format.

The document should generally be printed in the final form in which it will be executed.

Step 3: Execute the POA in the USA

The Principal must sign the Power of Attorney in accordance with the applicable execution requirements.

Depending on the circumstances and the authority with which the document will be used in India, the POA may be executed before:

  • The Indian Embassy/Consulate, or
  • A Notary Public in the USA, subject to the applicable requirements for use of the document in India.

Where the POA is executed before an Indian Consulate, the Principal signs the document before the consular official and the document is authenticated in accordance with the consular procedure.

Before execution, it is advisable to confirm the current requirements of the relevant Indian Consulate or the authority in India where the POA will ultimately be submitted.

Step 4: Send the Original POA to India

After execution, the original Power of Attorney should be sent to the Agent in India.

The document can be sent through a reputed courier service such as DHL or FedEx, or it may be hand-carried to India through a trusted person.

The original document is important because it will generally be required for the adjudication process in India.

Step 5: Prepare the Request Letter in India

After receiving the original POA, the Agent should prepare a request letter addressed to the concerned District Registrar Office (DRO) for adjudication of the document.

The request letter should contain the relevant details of the Principal, Agent, Power of Attorney, and the property transaction for which the POA is intended to be used.

Step 6: Pay the Applicable Stamp Duty

The applicable stamp duty must be paid for adjudication process,

For property located in Karnataka, the applicable stamp duty can be paid through the prescribed Karnataka government system, including the K2 portal, where applicable.

The amount of stamp duty depends on the nature and powers granted under the POA and the applicable provisions in force at the time of adjudication.

Therefore, the applicable stamp duty should be verified before making the payment.

Step 7: Submit the Documents at the District Registrar Office

The Agent should submit the required documents at the District Registrar Office (DRO) having jurisdiction over the property or as otherwise prescribed by the applicable rules.

The commonly required documents may include:

  • Original Power of Attorney
  • Request letter addressed to the District Registrar
  • Stamp duty challan/payment proof
  • Identity proof of the Principal
  • Identity proof of the Agent
  • Property-related documents, where required
  • Any additional documents or declarations requested by the registering authority

Step 8: Adjudication of the Power of Attorney

After submission, the District Registrar Office will examine the document and the supporting records for the purpose of stamp duty adjudication.

The authority may verify the nature of the POA, the powers granted, the supporting documents, and the stamp duty paid.

If the documents and stamp duty requirements are in order, the POA will be adjudicated and the relevant endorsement will be made on the document.

What Happens After POA Adjudication?

Once the Power of Attorney has been successfully adjudicated, the Agent can use the document for the purpose specified in the POA,

For example, where the POA authorizes the Agent to undertake a property transaction, the Agent may use the adjudicated POA for the relevant property-related formalities, including registration, where permitted.

Important Points to Remember

The procedure for a POA executed in the USA and used in India can vary depending on the purpose of the POA, the state where the property is located, the manner in which the document was executed, and the requirements of the receiving authority.

For this reason, the draft should be prepared carefully and the latest requirements should be verified before execution in the USA.
