Check ENCUMBRANCE CERTIFICATE (EC)

Let me give a real example: I took mortgage loan from Bank of Baroda to purchase 3BHK flat in Bangalore.

The Bank of Baroda registered the MODT in sub-registrar office for issuing mortgage loan. Below is the image of registered MODT.

The Mortgage lien (MODT details) reflected in my below EC, refer to encircle in below image

Note:

• Loan details reflect in EC only if the MODT registered in sub-registrar office
• Few banks and private lenders doesn’t register the MODT, they just collect the title documents from borrower, title documents include registered sale deed.

So in order to check the mortgage lien, 1st need to check the EC, and 2nd need check if you hold the tile documents.
