Power of Attorney (POA)
Follow the below procedure:
1. Draft :
Prepare the POA draft in word format.
2. Print:
Print the draft on A4-size paper.
3. Notary:
Meet the notary public near your place in USA
You should sign the POA in front of Notary
Notary seal & signs the POA
4. Transit:
Send the POA to your brother in India
5. Adjudication
Your brother should carry the following documents to District registrar’s office for adjudication of POA
- Original POA (which came from USA)
- ID proof of you and your brother (Id proof should establish the relationship, we mean that the father’s name should match in both the ID proof)
- Stamp duty payment receipt
- Requestion letter addressed to District Registrar
- Sale deed copy (applicable if the POA is for selling the property)
(Adjudication should be done in the jurisdiction of where the property is located)
6. District Registrar office (DRO)
- DRO verifies POA, ID proofs, and stamp duty payment.
- DRO adjudicates the POA.
This completes the procedure to give POA to your brother from USA.
Note:
- In Karnataka, the notarized GPA from USA is accepted for property registration. Attestation from Indian embassy in USA is not mandatory. (In the USA, you may have to travel long to get attestation from embassy. Cost of attestation is also high. So, notary is the best alternative option to bring down travel time and cost)
- In Karnataka, the stamp duty is Rs. 200
- Few other states in India, attestation from Indian embassy in USA is mandatory and notarized GPA is not accepted. so check your local regulation to follow the right procedure
