OPTION 1: THROUGH POWER OF ATTORNEY (POA)
An NRI landlord can authorize a trusted individual in India (such as a family member or local guide) to act on their behalf through a registered or notarized Power of Attorney (POA). The POA holder can then sign and execute the rental agreement with the tenant.
OPTION 2: WITH LOCAL ASSISTANCE (PHYSICAL SIGNING)
If the landlord prefers to sign the document personally, they can follow this method:
- Your local representative drafts the rental agreement.
- The tenant signs the agreement in India.
- The agreement is notarized locally.
- A scanned copy is emailed to the landlord.
- The landlord prints the document, signs all pages, and sends back the signed soft copy to the tenant via email.
This method is suitable when you wish to retain the traditional physical signing process.
OPTION 3: WITH LOCAL ASSISTANCE AND DIGITAL SIGNATURE (PAPERLESS PROCESS)
To simplify the process and reduce paperwork, NRIs can opt for digital signature platforms such as DocuSign, DigiSigner, EasySign, CamScanner, and others.
- The agreement is prepared and signed by the tenant in India.
- It is notarized by the local representative.
- A scanned copy is shared with the landlord by email.
- The landlord uses any secure e-signing platform to sign the agreement digitally.
- The signed document is emailed back to the tenant.
