Does a Registered Will Appear in the Encumbrance Certificate (EC)?

Short Answer: No, a registered Will does not reflect in the Encumbrance Certificate (EC).

WHY DOESN’T A REGISTERED WILL APPEAR IN THE EC?

In the sub-registrar’s office, Wills are recorded in Book No. 3—a register specifically maintained for documents that are not open to public inspection. Since the EC is generated based on transactions recorded in Book No. 1, which includes sale deeds, gift deeds, mortgage deeds, and other conveyances, Wills registered in Book No. 3 do not appear in the EC.

CAN A CERTIFIED COPY OF A WILL BE OBTAINED?

Yes, although a registered Will does not reflect in the EC, a certified copy of the registered Will can be obtained from the sub-registrar’s office. To do so, you will need the document number and registration details of the Will.
