Can I Sell My Plot if the Khata Is Not Transferred to My Name from the Builder?

If your plot is registered in your name but the Khata (eKhata) has not been transferred from the builder to you, it may pose challenges during resale. While the registered Sale Deed proves ownership, BBMP or local municipal authorities require the Khata to be in your name for property tax assessment and for legal transfer during resale.

IS EKHATA MANDATORY FOR SELLING A PROPERTY?

Yes, having an eKhata in your name is generally mandatory, especially for selling flats or plots in BBMP, BDA or Panchayat limits. Without an updated Khata, the buyer may not be able to apply for home loans or complete registration, and registration authorities reject the sale transfer application.


WHAT IS THE COST OF KHATA TRANSFER?

The Khata transfer fee is calculated as 2% of the stamp duty paid during the registration of your sale deed.

Example:

  • Property Purchase Price: Rs.50,00,000
  • Stamp Duty Paid (at 5%): Rs.2,50,000
  • Khata Transfer Charges (2% of Rs.2,50,000): Rs.5,000
  • Additional Charges: Rs.125 (application download fee)

PROCESSING TIME

The Khata transfer from the builder to the buyer’s name typically takes 15 working days, subject to the submission of all necessary documents, including the latest Encumbrance Certificate (EC).
