Can I buy a flat if it is registered in the seller’s name but the Khata is not transferred to seller from the builder?

Ekhata is mandatory to tranfer the property from seller to buyer.  Withour ekhata, one cannot able to tranfer the property from seller to buyer It takes around a week to obtain the ekhata for a property transfer
