Can an NRI Register a Will in Karnataka Without an Aadhaar Card? Is a PAN Card Sufficient?

Yes, an NRI can register a Will in Karnataka without an Aadhaar card. A valid PAN card is sufficient for the registration process.

Let me illustrate this with a real-life example

One of my NRI clients, a long-time resident of the USA, recently decided to execute and register her Will in India. Although registration of a Will is not mandatory, she opted to register it to ensure clarity and avoid any potential disputes over her assets after her lifetime.

Despite not holding an Aadhaar card, she did possess a PAN Card and an Overseas Citizen of India (OCI) card. Based on these documents, we successfully completed the Will registration process using her PAN as the primary identification.

DOCUMENTS REQUIRED FOR WILL REGISTRATION

For the registration of the Will, we prepared the following documents:

  • Testator’s PAN card
  • Aadhaar cards of two witnesses

STEP-BY-STEP PROCEDURE FOR WILL REGISTRATION

  1. Drafting the Will:
The Will was initially drafted using a Word document and reviewed thoroughly for accuracy and clarity.
  2. Application Submission:
We submitted the application for registration via the Kaveri Online Services Portal.
  3. Government Fees:
  4. Stamp Duty: Not applicable for Will registration
  5. Registration Fee: Rs 200
  6. Scanning Fee: Rs.. 50 per page. Our document was 8 pages long, so the total scanning fee amounted to Rs.400.
  7. Slot Booking:
We booked an appointment slot for registration at the relevant Sub-Registrar’s Office. (Please note: A Will can be registered at any Sub-Registrar’s Office, regardless of the location of the property or the testator.)

DOCUMENTS PRESENTED AT THE SUB-REGISTRAR’S OFFICE

  • Summary Report from Kaveri Portal
  • Printed copy of the Will (to be registered)
  • Two witnesses (physically present) with their Aadhaar cards

REGISTRATION PROCESS

  • We visited the Sub-Registrar’s Office with all the required documents as per the scheduled registration slot.
  • The preliminary procedures, including drafting the Will, submitting the online application, and coordinating the registration were completed within two days. These steps were handled remotely, without requiring the physical presence of the NRI client.
  • The NRI client was required to be physically present at the Sub-Registrar’s Office only for approximately 10 minutes, solely for the purpose of executing the registration of the Will.
  • After the registration was completed, we coordinated with the Sub-Registrar’s Office to ensure the scanning of the registered Will was handled promptly. We also arranged for home delivery of the registered document, so that my client did not have to wait at the Sub-Registrar’s Office for an additional 30 - 45 minutes.
