When availing an additional or top-up home loan, many borrowers wonder whether they must register the Memorandum of Deposit of Title Deed (MODT) at the same Sub-Registrar’s Office where the original MODT was registered.
The answer is No, it is not mandatory to register the MODT at the same Sub-Registrar’s Office. Borrowers have the flexibility to choose any Sub-Registrar Office from the available list when registering a new or additional MODT.
REAL CASE EXAMPLE: MODT REGISTRATION FOR AN ADDITIONAL HOME LOAN
To illustrate this, let me share a real-life case handled in my practice:
In July 2023, one of my clients availed a home loan of Rs 74.65 lakhs from Bank of Baroda. The MODT for this loan was registered at the Begur Sub-Registrar’s Office, Bengaluru.
Later, in September 2025, the same client applied for an additional (top-up) home loan of Rs 63.42 lakhs from the same bank. During the MODT registration process for this new loan, we reviewed the earlier MODT, which clearly mentioned the previous loan amount of Rs 74.65 lakhs and the location of registration is the Begur Sub-Registrar Office. (Refer to the image below.)

SELECTING THE SUB-REGISTRAR’S OFFICE FOR MODT REGISTRATION
When submitting the application for MODT registration, the system allows the applicant to choose from a list of Sub-Registrar Offices. This means that even if the earlier MODT was registered in one office, you are free to select another Sub-Registrar Office listed under your property jurisdiction
In this particular case, the previous MODT was registered at the Begur Sub-Registrar Office, but for the additional loan, we selected the Jayanagar Sub-Registrar Office from the available list. (See the highlighted portion in the image below.)

MODT REGISTRATION DETAILS OF THE ADDITIONAL LOAN
The additional loan of Rs 63.42 lakhs was successfully registered on 23rd September 2025 at the Jayanagar Sub-Registrar’s Office.
The MODT document clearly reflects the loan amount and the Sub-Registrar Office name, confirming that borrowers are not restricted to the same office as the original registration. (Refer to the image below.)

KEY TAKEAWAYS
- Not Mandatory: It is not required to register an additional or top-up loan MODT at the same Sub-Registrar Office as the previous one.
- Freedom of Choice: Borrowers can select any Sub-Registrar Office listed in your MODT application.
