In Karnataka, two primary types of Power of Attorney can be executed

  • Notarized Power of Attorney
  • Registered Power of Attorney

Each type serves different purposes and involves distinct procedures and costs. Below is the detailed breakdown of both.


NOTARIZED POWER OF ATTORNEY

A notarized POA is authenticated by a notary public, who verifies the content of the Power of Attorney, the signatures, and the identity of the parties involved. Upon the verification, the Notary Public attests the POA.

PROCEDURE:

Follow these steps to execute a notarized POA:

  1. Draft the Power of Attorney in a Word document
  2. Purchase a non-judicial e-stamp paper (available at the co-operative bank, near the sub-registrar office, or authorized stamp vendors)
  3. Print the draft on e-stamp paper. Use A4-size bond paper for additional pages
  4. Visit the nearest Notary Public with the following documents:
    • The Printed Power of Attorney
    • Government-issued identification proof (e.g., Aadhaar, Passport) of both the Principal and Attorney,
    • Two witnesses (along with their ID proofs)
  5. Notary Public will verify the documents, including the POA, Identity proofs, and the signature of the parties
  6. Notary Public attests the Power of Attorney

COST BREAKDOWN

  • Stamp Duty: Rs. 500
  • Vendor processing fee Rs. 50
  • Paper and printing cost Rs. 50 (approx.)
  • Notary Fee Rs. 250 (Approx.)

The Total Cost is Rs. 850

USE CASES:

  • Ideal for banking purposes, such as collecting property documents from a bank after the closure of a home loan
  • Not valid for property transactions, such as buying, selling, or gifting at the sub-registrar’s office

REGISTERED POWER OF ATTORNEY

A Registered Power of Attorney executed at the sub-registrar's office and officially recorded in the registrar's database. The registered POA is mandatory for property-related transactions in the sub-registrar's office.

PROCEDURE:

To register a Power of Attorney, follow these steps:

  1. Draft the Power of Attorney in a Word document
  2. Print the Draft on Document paper
  3. Principal, Attorney, and two witnesses sign the POA
  4. Submit the application via Kaveri Online Services. The link https://kaverionline.karnataka.gov.in
  5. Pay the applicable government fee (Stamp Duty & Registration fee)
  6. Book an appointment for registration at the sub-registrar’s office
  7. Visit the Sub-registrar's office at the scheduled time with the following documents
    • Signed POA
    • Application summary report

COST BREAKDOWN:

  • Stamp Duty: Rs. 1000
  • Registration Fee: Rs. 200
  • Scanning fee: Rs. 300 (for 6 pages, Rs. 50 per page)

Total cost is Rs. 1.500

NOTE:

  • The Stamp Duty and Registration fees are fixed irrespective of property value.
  • We can register at any sub-registrar office and are not restricted to the property jurisdiction. It means you can choose the nearest sub-registrar office
