How to Get a Copy of a Previous Sale Deed in Karnataka

A previous sale deed is a critical document in any property transaction. It serves as legal proof of prior ownership and is often required for:
  • Selling a property
  • Buying a property
  • Property settlements
  • Ownership verification
If you’re purchasing a property, the seller should hand over all original title documents, including the previous sale deed, immediately after registration. Unfortunately, many buyers are unaware of this requirement until it becomes a problem later. REAL-LIFE CASE STUDY – WHY THIS MATTERS In October 2020, my client, Mr. Madhu, purchased a flat in Bangalore. At the time of registration, the seller did not hand over the previous sale deed, and Mr. Madhu unaware of its importance, did not request it. Three years later, when Mr. Madhu decided to sell his property, the prospective buyer requested both the current and previous sale deeds for verification. Unfortunately, the original previous deed was not in Mr. Madhu’s possession. Attempts to contact the earlier seller failed, as they were no longer reachable. HOW WE RETRIEVED THE PREVIOUS SALE DEED The only way forward was to obtain a certified copy of the previous sale deed. This required finding the registration number of the earlier transaction. We followed two methods: Option 1 – Checking the Current Sale Deed We reviewed the history of transactions section in Mr. Madhu’s current sale deed. This section mentioned the registration number of the previous deed, which we highlighted for reference. Registration number 1 Option 2 – Reviewing the Encumbrance Certificate (EC) We obtained an Encumbrance Certificate for the property, which also lists past transactions. The registration number of the previous deed was visible here as well. EC 1 With the registration number in hand, we successfully extracted the certified copy of the previous sale deed online.
