How to Terminate a Registered Lease Deed in Bangalore

When a lease deed is registered, it becomes part of the public record and appears in the Encumbrance Certificate (EC). If the property owner decides to sell the property before the lease period ends, the existing lease must be legally closed. The correct procedure is to register a “Surrender of Lease” at the sub-registrar’s office where the original lease deed was executed. Let me share a real-life case study from our experience.

CASE STUDY: TERMINATION OF A LEASE DEED BEFORE EXPIRY

One of our clients owned a property in Bangalore. We identified a tenant, and a lease deed was registered at the Rajajinagar Sub-Registrar Office for:

  • Lease value: Rs.9.95 lakh
  • Duration: 3 years

THE SITUATION

Before the lease term ended, the owner decided to sell the property. A buyer was finalized, and a down payment of Rs.2 lakh was made. However, during document verification, the buyer noticed the lease entry in the EC.

The buyer insisted that the lease transaction must be cleared from the EC before proceeding with the sale deed registration.

Notice to Tenant

As per the lease deed, we issued a two-month notice to the tenant. The tenant accepted and vacated the property at the end of the notice period.

Registration of Surrender of Lease

We registered the “Surrender of Lease” at the same Rajajinagar Sub-Registrar Office where the original lease deed was executed. Refer to the image below

Refund of Lease Amount

At the sub-registrar office, the owner refunded the lease value of Rs.9.95 lakh to the tenant through a Demand Draft (DD).

Updated Encumbrance Certificate (EC)

After registration, we extracted a fresh EC. It reflected:

  • Lease Deed (Entry 1)
  • Surrender of Lease (Entry 2)

This confirmed that the lease transaction was legally terminated and closed in the records.

WHY REGISTER A SURRENDER OF LEASE?

If the surrender is not registered, the lease entry continues to appear as “active” in the EC. This creates hurdles in property sales or future transactions. Registering the surrender ensures the lease is officially closed and reflected as such in the EC.

STEP-BY-STEP GUIDE TO SAFE LEASE TERMINATION

Issue Notice – Send notice to the tenant as per lease deed terms. Notice can be given via email, SMS, WhatsApp, or postal mail.

  • Residential property: usually 1–3 months' notice
  • Commercial property: usually 3–6 months' notice

Tenant Vacates Property – Ensure smooth handover.

Property Damage Assessment – Inspect for damages and either recover costs from the tenant or request them to repair before vacating.

Register Surrender of Lease – Both landlord and tenant must visit the sub-registrar's office to register the surrender.

Refund Lease Deposit/Advance – Refund the lease amount or security deposit to the tenant after deductions, if any.
